(CAGE: 02024) Approved Source: Photo-Sonics, Inc. (CAGE: 02024) This Request for Proposals (RFP) / Delivery Order solicitation is issued pursuant to the terms and conditions of Basic Ordering Agreement N0038326G0005. All clauses, terms, conditions, and general provisions contained within BOA N0038326G0005 are incorporated herein by reference and apply fully to this procurement action, except as modified herein or in subsequent contract modifications. This requirement is restricted to Photo-Sonics, Inc. (CAGE 02024) under the statutory authority of 10 U.S.C. 3204(a)(1) (or 10 U.S.C. 2304(c)(1)), as imlemented by FAR 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." Photo-Sonics, Inc. is the original equipment manufacturer (OEM) and sole source of supply holding requisite manufacturering, drawings, tooling, and technical baseline data. Repair Turnaround Time (RTAT) definition: The contractual delivery requirement is measured from asset acceptance under the terms of the contract. For purposes of this section, Return is defined as physical receipt of the F-condition asset at the contractor's facility as reflected in the Action Date entry in the Commercial Asset Visibility (CAV) system. In accordance with the CAV Statement of Work, the contractor is required to accurately report all transactions by the end of the fifth regular business day after receipt and the Action Date entered in CAV must be dated to reflect the actual date of physical receipt. The Contractor must obtain final inspection and acceptance by the Government for all assets within the RTATs established in the subsequent contract. Throughput Constraint: Contractor must provide a throughput Constraint for each NSN(s). Total assets to be repaired monthly after initial delivery commences X/month (contractor fill in #).
